By what date must an initial petition for relief in a seizure and a penalty case be filed?
How to get there
19 CFR 171.2(b): When filed(1) Seizures. Petitions for relief from seizures must be filed within 30 days from the date of mailing of the notice of seizure.
(2) Penalties. Petitions for relief from penalties must be filed within 60 days of the mailing of the notice of penalty incurred.
(2) Penalties. Petitions for relief from penalties must be filed within 60 days of the mailing of the notice of penalty incurred.
Seizures 30, penalties 60: D.
Why the other choices are wrong
A) 60 days for both and B) 30 days for both: each applies one deadline to both cases. They differ.
C) 60 for seizures, 30 for penalties: the two numbers swapped.
Tip
A memory hook: seized goods are urgent (30), penalties can wait a bit (60). The FP&F Officer can extend either (§ 171.2(c)). If fewer than 180 days remain on the statute of limitations, the notice can set a shorter period, but never less than 7 working days (§ 171.2(e)).
