Which of the following is NOT a method for establishing tariff-rate and absolute quotas?
How to get there
19 CFR 132.2(a): EnactmentTariff-rate quotas and absolute quotas are established by Presidential proclamations, Executive orders, and legislative enactments. These documents are published in the Customs Bulletin.
Exactly three methods are listed. U.S. Trade Representative orders isn't one of them: C.
Why the other choices are wrong
A) Executive orders, B) Presidential proclamations and D) Legislative enactments are the three methods named in § 132.2(a).
Trap!
USTR is deeply involved in trade policy (Section 301 actions, for example), which is why it sounds right. But § 132.2(a) names only the President (proclamations, executive orders) and Congress (legislation). Under § 132.2(c), the terms that create a quota are strictly construed.
