Which of the following is NOT a requirement with respect to additional articles or classes of articles designated Instruments of International Traffic?
How to get there
This is a "NOT" question, so three statements reflect § 10.41a and one contradicts it. The giveaway is in the first paragraph:
19 CFR 10.41a(a)(1)… The Commissioner of Customs is authorized to designate as instruments of international traffic … such additional articles or classes of articles as he shall find should be so designated. Such instruments may be released without entry or the payment of duty, subject to the provisions of this section.
Entry and payment of duty before release are exactly what IIT status removes. So C is not a requirement.
Why the other statements are true requirements
A) Exit within 365 days: § 10.41a(g)(1): a container designated as an IIT "is deemed to remain in international traffic provided that the container exits the U.S. within 365 days of the date on that it was admitted."
B) Accessories must come with a container: § 10.41a(a)(3): IITs include "the normal accessories and equipment imported with any such instrument which is a 'container' …"
D) A CF 301 bond with § 113.66 conditions: § 10.41a(c): instruments "may be released … only after the applicant for such release has filed a bond on Customs Form 301, containing the bond conditions set forth in § 113.66."
Tip
The IIT bargain: no entry and no duty at release, in exchange for a bond (§ 113.66 conditions), the 365-day exit rule for containers, and the obligation to file a consumption entry if the instrument is diverted to local traffic (§ 10.41a(d)–(e)). A container that misses the 365 days needs a consumption entry within 10 business days after the end of that month.
